TERMS:
By booking a shoot with Bucks County Video LLC., you agree to abide by Bucks County Video LLC’s, terms of trade. Any changes to these terms must be in writing and signed by both parties.
WORKING PRACTICES:
Bucks County Video LLC. is committed to providing a high quality, cost-effective video production service to domestic and international clients. With decades of experience we have assembled some of the best video production professionals in the Pennsylvania, New Jersey & New York areas, as well as across the country and across the globe. In order for you to understand the process of video production services, it is important to read through our terms of trade.
PERSONNEL BOOKING PROCEDURE:
Bucks County Video LLC. represents high quality, non-union camera crews and other production personnel around the country. It is important for our clients to understand that once we put you in touch with our crew members, we encourage you to book them directly for future projects.
WORKING DAY:
Bucks County Video LLC. production personnel work on a standard ten hour day “portal to portal” or “door to door” basis. Portal to portal is defined as from the time the crew leaves home base to the time they return the equipment to home base. Overtime, if incurred after ten hours, is charged at time and a half until the production is concluded.
PRODUCTION EXPENSES:
The client is responsible for all relevant production expenses incurred during a shoot such as: overtime, discs, expendables, tolls, parking, excess baggage, delivery charges, per diems, and any other applicable expenses.
PER DIEMS:
If a crew is working over 90 miles from home base or is staying overnight at a location, a per diem of $50.00 USD, per crew member, per day is applicable. This applies to both shoot days and travel days.
MEAL BREAKS:
The crew is entitled to a meal break every six hours. While we try to be as understanding as possible and not charge meal penalties, technically when a meal break is missed a client is liable to pay such penalties. It is at Bucks County Video LLC. discretion as to whether such penalties are charged. A missed meal break is one hour of overtime per missed meal.
COMPANY LIABILITY:
Bucks County Video LLC. liability due to failure of equipment is limited to the amount charged for the item in question. Bucks County Video LLC. liability due to operator error is limited to the amount charged for the operator in question. Bucks County Video LLC. is not responsible for any post-production costs or re-shooting costs that may be incurred due to the failure of the equipment or an error by the operator. With “one-man band” or camera operator only shoots, Bucks County Video LLC. is not liable for any audio problems. If a client decides not to hire a professional sound engineer, they will do so at their own risk and assume full responsibility for any problems that may occur. The client must check through all equipment that is rented. If there is anything wrong with the equipment upon delivery, it must be reported immediately.
If it is not, Bucks County Video LLC. will assume the equipment was damaged on the shoot and the client will be responsible for paying for the repair costs. Any equipment problems that occur during a shoot must be reported during the rental period. Bucks County Video LLC. will not be liable for any malfunctioning equipment if the problem is reported after the shoot has been completed. Bucks County Video LLC. is not responsible for technical problems that are beyond its control that can occur during a shoot. If a client decides to book a producer / DP / director through Bucks County Video LLC. it is the client’s responsibility to clearly communicate to that producer / DP / director their requirements for both visual and editorial content. Bucks County Video LLC. will make every effort to provide full resume details for a suggested producer / DP / director but shall in no way be liable for the aesthetic or editorial decisions made by that producer / director on the production. Prior to the shoot, the client should check quotes/estimates thoroughly.
Bucks County Video LLC. is only responsible for providing the specific equipment listed in our quotes/estimates. clients should be aware that equipment such as wide angle lenses, matte boxes and filters are not part of Bucks County Video LLC. standard equipment package and must be specifically requested. If a client has an issue with any element of an invoice, it is the client’s responsibility to communicate that issue in writing to the Bucks County Video LLC. staff in a timely manner. Bucks County Video LLC. is not liable for any issue that is raised by a client more than two weeks after receipt of the invoice.
MULTI-CAMERA SHOOTS:
Please note that all cameras are different. We cannot guarantee that two cameras will match, even if they are the same model and have a setup card. If a client wants to have two or more cameras match exactly, a video engineer with paint boxes must be hired for the production. If an engineer is not brought in, Bucks County Video LLC. cannot guarantee that the cameras will match.
HOLD, CONFIRMATION, AND CANCELLATION:
When booking a crew with Bucks County Video LLC. the first step is putting that crew “on hold.” However, a hold does NOT guarantee that crew member will be available for the client’s shoot. If another job is offered to the crew member, they will contact Bucks County Video LLC. to see if our job is confirmed. If our job is not confirmed, we may lose that crew member to the other job. This policy is in place to protect our crews, who are media professionals that rely on steady work. If we cannot confirm our job, we cannot prevent them from accepting a different, confirmed, job. Once a crew member is “confirmed,” they are locked in to our shoot and will have to pass up on any other job during the confirmed period. As such, once a crew member is confirmed the below cancelation policy will apply.
For confirmed basic single camera shoots:
After confirmation, but more than 48 hours prior to the shoot – 50% chargeUnder 48 hours prior to the shoot – 100% charge For confirmed large productions such as multi-camera shoots, live event coverage, etc:
After confirmation but more than 5 days prior to event – 50% charge
Under 5 days – 100% charge For Weekend shoots:
If a shoot is scheduled for a Saturday, Sunday, or Monday and it is cancelled on Friday or after – this is considered less than 24 hours and is billed in full.
Production Coordination Fee:
On shoots where Bucks County Video LLC. is charging a production coordination fee, coordination time will be billed for even if a shoot is canceled.PAYMENT POLICY:All new clients are required to pay 100% of all known costs in advance of a production to confirm and lock in crew. After a working relationship has been established, it is possible to apply to be billed on a net 30 day basis. A credit application must be completed and approved before invoicing can begin. Credit applications can take several weeks to process. Once a client is approved for invoicing, payment must be received within 30 days of the invoice date or a late penalty of $30.00 USD plus 1.5% interest per month will be assessed.
MEDIA SHIPPING POLICY:
If Bucks County Video LLC. or any of its personnel ship tapes or discs to a client, Bucks County Video LLC. is not liable for any loss or damage to those tapes/discs. If a re-shoot is required because tapes or discs are lost in transit, the costs will be borne entirely by the client.EQUIPMENT SHIPPING POLICY:Bucks County Video LLC. is not responsible for any costs due to delays of shipped camera(s) or other equipment.
EQUIPMENT OUT OF U.S. POLICY:
If the camera equipment is taken out of the United States, the client takes full responsibility for any problems that may arise. In the event of an equipment malfunction, the client is fully responsible for all costs and logistics associated with the replacement of the equipment.
LIMITATION OF LIABILITY:
Under no circumstance shall Bucks County Video LLC. and its subsidiaries, directors, employees or affiliates be liable for any indirect, incidental, special, punitive or consequential damages (including, without limitation, lost profits) whether or not foreseeable, that result in any way from a customer’s use of or inability to use the service or the equipment obtained through the service, or customer’s reliance on information provided, or that result from mistakes, omissions, interruptions, deletions or any failure of performance, even if Bucks County Video LLC. has been advised of the possibility of such damages.
INDEMNIFICATION:
Customer agrees to indemnify, defend and hold Bucks County Video LLC. and its subsidiaries, directors, employees and affiliates harmless from any claims, losses or damages, including attorney’s fees, relating to any violation of this agreement by customer or placement of or transmission of any message, information, software or other materials by customer or user authorized by customer to do so. This indemnification shall survive the termination of the agreement.——–This agreement contains the entire understanding between both parties, including representations, and may not be modified except by another agreement in writing, signed by both parties to the agreement. No terms, representations or warranty expressed or implied, not herein set forth in writing shall bind Bucks County Video LLC..This agreement shall be interpreted and governed by the laws of the State of Pennsylvania applicable to agreements completely executed and performed therein as if so expected and performed.
